What are the requirements for applying for a patent?
The technology for patent application needs to meet three conditions: novelty, creativity and practicality.
1. Novelty means that the technology does not belong to the prior art, and no entity or individual has applied to the patent administration department under the State Council for the same invention or utility model before the application date.
Therefore, when applying for a patent, the applicant should pay attention to:
First, we should apply for a patent as soon as possible, or even when there is only one idea, we should prepare to apply for a patent;
Second, before applying for a patent, the invention technology must not be published in a paper or in any form, so as not to affect the novelty of the patent examination.
2. Creativity means that, compared with the prior art, the invention has prominent substantive features and significant progress, and the utility model has substantive features and progress. For example: higher efficiency, less cost, etc.
3. Practicability means that the technology of the invention can be manufactured or used and can produce positive effects.
